Abstract

In less than twenty years, China has made tremendous progress in establishing an intellectual property rights (IPR) system. With virtually no IPR legislation at all in the early 1980s, China now has a fairly comprehensive and modem IPR system. This paper evaluates the effects of the establishment of the IP system on the research and development (R&D) efforts of Chinese innovators, and identifies the main problems that, the Chinese government must solve in order to improve the IPR system. After introducing the major developments in the history of China’s young IPR system in the second section, the following lection of the paper reviews the role of the United States in the establishment of China’s IPR system. The analysis of the IP law enforcement in the fourth section leads to two suggestions as to how enforcement of the Chinese IP laws might be enhanced. The fifth section investigates the composition of the R&D efforts made by Chinese inventors, and section six summarizes the results of the analysis.
