Protection of married women as guarantors

Abstract

Recent decisions of the House of Lords and the New South Court of Appeal have raised questions as to the status of observations made by Dixon J in Yerkey v Jones and the ambit of the principles discussed in Commercial Bank of Australia Ltd v Amadio in their application to married women as guarantors. The author concludes that these questions are ripe for review by the High Court of Australia.
